PRIVACY POLICY

1. Data controller

Processing is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 110/2019 Coll., on personal data processing.
2. What data we process
We process data necessary for operation of the Lajkto ecosystem, in particular registration and contact data, login data, technical data, IP address, device type, cookies, logs, account settings, user content, videos, images, music, comments, chat, voice messages, live activity, records of the use of digital functions, data on internal credit, KCoins, gifts, boosts, orders, payments, refunds, chargebacks and data needed for payouts to authors, such as bank account, identification data and tax or accounting data.
3. Purposes of processing
We process data for the purpose of operating and securing the Service, managing user accounts, login, communication with the user, displaying content, moderation, handling reports, providing digital functions, payments, internal credit, rewards for authors, the partner program, accounting, fulfilment of tax and legal obligations, handling complaints, refunds, chargebacks, fraud prevention, protection of the Operator's rights and improvement of the Service.
4. Legal basis
The legal basis for processing is in particular performance of a contract, fulfilment of legal obligations, the legitimate interest of the Operator in secure operation and protection of rights, and in some cases the user's consent. Consent may be withdrawn at any time without affecting the lawfulness of processing before its withdrawal.
5. Cookies and similar technologies
The Service uses necessary cookies and similar technologies required for operation, login and security; these are processed on the basis of legitimate interest. Analytical, statistical or marketing cookies are used only on the basis of consent given through the consent settings (cookie banner), which can be changed or withdrawn at any time.
6. Recipients and processors
Data may be made available, to the necessary extent, to processors and recipients, in particular hosting and technical infrastructure providers, payment service and payment gateway providers, banks, accounting and tax advisors, legal advisors, providers of analytics, delivery or security services, and public authorities where required by law or for the protection of rights. The Operator concludes data processing agreements with processors. The Operator will provide a current overview of categories of recipients upon request sent to admin@lajkto.eu.
7. Transfers outside the EEA
Data is generally processed within the European Economic Area. If a transfer to a third country occurs (for example when using a technical or analytical tool), the Operator ensures appropriate safeguards under the GDPR, in particular an adequacy decision or the European Commission's standard contractual clauses.
8. Retention period
We keep data only for as long as necessary. Account data for the duration of the account and a reasonable period thereafter to protect rights and resolve disputes; accounting and tax documents for the period required by law (generally up to 10 years); data for the platform's reporting obligations for the period required by tax law; operational and security logs generally for a period of several months up to one year. After the period expires, we delete or anonymize the data.
9. Automated processing
For security, fraud prevention and protection of the Service, the Operator may use automated tools (for example to detect misuse, fake accounts or suspicious transactions). These tools are supportive in nature; decisions with a significant effect on the user are subject to human review. The user may request a review at admin@lajkto.eu.
10. Platform tax reporting obligations (DAC7)
If the Operator pays rewards to authors, as an operator of a digital platform it is obliged to collect, verify and report to the tax authority the identification and tax data of reportable authors and the amounts paid (DAC7; Act No. 164/2013 Coll.). This data is processed for the purpose of fulfilling a legal obligation.
11. Children
The Service is not intended for children under 15 and the Operator does not knowingly process their personal data without the consent of a legal guardian. If it discovers that it has obtained such data, it will delete it without undue delay.
12. User rights
The user has the right of access, rectification, erasure, restriction of processing, portability, objection to processing and withdrawal of consent where processing is based on consent. Requests may be sent to admin@lajkto.eu.
The user has the right to lodge a complaint with the Czech Office for Personal Data Protection (Úřad pro ochranu osobních údajů), registered office Pplk. Sochora 27, 170 00 Prague 7, web uoou.gov.cz.
13. Security
The Operator adopts technical and organisational measures to protect data against unauthorized access, loss, misuse or alteration. No system can be considered absolutely secure, and the user must also protect their own access credentials.
